Personal Data may be freely provided by the User, or, in case of Usage Data, collected automatically when using this Application. Users who are uncertain about which Personal Data is mandatory are welcome to contact the Owner.

Unless specified otherwise, all Data requested by this Application is mandatory and failure to provide this Data may make it impossible for this Application to provide its services. In cases where this Application specifically states that some Data is not mandatory, Users are free not to communicate this Data without consequences to the availability or the functioning of the Service.

The Owner may process Personal Data relating to Users if one of the following applies:

• Data related to a task that is carried out in the public interest or in the exercise of official authority vested in the Owner;

STUDENTS & PARENTS OF ROCK OUT ACADEMY

• Consent to Data Collection to be used within the student portal located at https://rockoutacademy.mymusicstaff.comParent/Student Portal. All Rock Out Academy students need to be registered with our parent/student portal in order to enroll in private lessons, group classes, or programs. The portal is how we communicate with parents & students, collect payments, process cancellations, facilitate schedules, etc. All adult students and parents of minors are required to set up a credit card within the portal for the collection of any fees that are due. Rock Out Academy, its teachers, & staff do not have access to student credit card information within the portal. The collection & processing of credit card information is facilitated by My Music Staff, PayPal, Venmo, & is SSL encrypted. Any invoices sent to student/parent email addresses also have SSL encryption.

• Consent to contact by text/email. All students/parents of students are contacted before we bill for lessons/programs. All students are required to receive texts or email for this purpose. We will also send messages regarding scheduling changes or important information.

• Consent to Photography & Video. All students who take lessons, group or pop-up classes, or participate in open jam/other programs consent to having their photograph/video taken. These images/media may be used for promotion of Rock Out Academy and its lessons, programs, classes, & events even after the student is no longer taking lessons.

• Right to Modify & Update: Rock Out Academy has the right to update or modify this policy and any other policies freely at any given time. Students and parents have the right to request a complete printout of all policies at any time. They may also access these policies online at https://rockoutacademy.com & https://rockoutacademy.mymusicstaff.com.

• Students & Parents Consent to these terms when they sign up at https://rockoutacademy.mymusicstaff.com/enroll in any program offered by Rock Out Academy.

The rights of Users based on the General Data Protection Regulation (GDPR)

Users have the right to do the following, to the extent permitted by law:

• Withdraw their consent at any time. Users have the right to withdraw consent where they have previously given their consent to the processing of their Personal Data.

• Access their Data. Users have the right to learn if Data is being processed by the Owner, obtain disclosure regarding certain aspects of the processing and obtain a copy of the Data undergoing processing.

• Verify and seek rectification. Users have the right to verify the accuracy of their Data and ask for it to be updated or corrected.

• Restrict the processing of their Data. Users have the right to restrict the processing of their Data. In this case, the Owner will not process their Data for any purpose other than storing it.

• Have their Personal Data deleted or otherwise removed. Users have the right to obtain the erasure of their Data from the Owner.

• Receive their Data and have it transferred to another controller. Users have the right to receive their Data in a structured, commonly used and machine-readable format and, if technically feasible, to have it transmitted to another controller without any hindrance.

• Lodge a complaint. Users have the right to bring a claim before their competent data protection authority.

PHOTO & VIDEO RELEASE POLICY

Once you enroll for 1 or more lesson of Rock Out Academy, you give permission to Rock Out Academy and those acting pursuant to its authority to: (i) record your likeness and/or voice on a video, audio, photographic, digital, , electronic, or other medium; (ii) use my name and other biographical material in connection with such recordings; and (iii) use, reproduce, exhibit and/or distribute your name, biographical material, and such recordings in any medium (e.g., print, publications, video, internet, etc.)  for promotional, advertising, educational, and/or other lawful purposes. 

Parents and students of Rock Out Academy release and waive any claims or rights of compensation or ownership regarding such uses and understand that all such recordings shall remain the property of Rock Out Academy. Rock Out Academy students understand that use of the student/parent portal grants automatic permission to use photo and video and all above referenced media for the use of advertisements on https://rockoutacademy.com, https://rockoutacademy.mymusicstaff.com, and Rock Out Academy social media pages for the purpose of advertisements, publications, contests, and other business relations.

The User's Personal Data may be used for legal purposes by the Owner in Court or in the stages leading to possible legal action arising from improper use of this Application or the related Services.
The User declares to be aware that the Owner may be required to reveal personal data upon request of public authorities.

In addition to the information contained in this privacy policy, this Application may provide the User with additional and contextual information concerning particular Services or the collection and processing of Personal Data upon request.

System Logs and Maintenance

For operation and maintenance purposes, this Application and any third-party services may collect files that record interaction with this Application (System logs) or use other Personal Data (such as the IP Address) for this purpose.

Commitment to Students & Families

Rock Out Academy will never sell student/family information such as email addresses, phone numbers, addresses, or access credit card information for any other purpose than to invoice/bill a student each time payments are due. We respect privacy and the safety of every student & family.
